Lodging Terms and Conditions

Article 1 (Scope of Application)
1. Lodging contracts and related contracts entered into between the Inn and guests shall be subject to these Terms, and matters not stipulated herein shall be governed by relevant laws and regulations or generally established customs.
2. If the Inn agrees to special provisions that do not violate laws or customs, such provisions shall prevail notwithstanding the previous paragraph.
Article 2 (Application for Lodging Contract)
1. A person wishing to apply for a lodging contract shall provide the following information:
(1) Name of the guest (representative and number of companions)
(2) Date(s) of stay and estimated time of arrival
(3) Lodging charges (in principle based on the basic charge in Appendix 1)
(4) Other matters deemed necessary by the Inn
2. If a guest requests to extend their stay beyond the originally agreed date during their stay, such request shall be treated as a new application for a lodging contract at the time it is made.
Article 3 (Conclusion of Lodging Contract)
1. A lodging contract shall be concluded when the Inn accepts the application referred to in the preceding article. However, this shall not apply if the Inn can prove that it did not accept the application.
2. Upon conclusion of a lodging contract, the guest shall pay an application fee determined by the Inn, up to the basic lodging charge for the period of stay (3 days if the stay exceeds 3 days), by a date designated by the Inn.
3. The application fee shall first be applied to the lodging charges ultimately payable by the guest. If circumstances arise that invoke Article 6 or Article 17, the fee shall be applied in the order of penalty charges followed by damages, with any remaining balance refunded at the time of payment of charges under Article 11.
4. If the application fee is not paid by the designated date, the lodging contract shall lose its effect. This shall apply only when the Inn has notified the guest of the payment deadline.
Article 4 (Special Provisions Waiving Application Fee)
1. Notwithstanding Article 3(2), the Inn may agree to special provisions waiving the application fee after conclusion of the contract.
2. If the Inn does not request payment of the application fee or designate a payment deadline upon accepting the lodging application, this shall be treated as agreeing to the special provisions in the preceding paragraph.
Article 4-2 (Request for Cooperation with Infection Prevention Measures)
The Inn may request cooperation from prospective guests under Article 4-2, paragraph 1 of the Inn Business Law (Act No. 138 of 1948).
Article 5 (Refusal of Lodging Contract)
1. The Inn may refuse to enter into a lodging contract in the following cases. This paragraph does not mean the Inn may refuse lodging in cases other than those specified in Article 5 of the Inn Business Law.
(1) When the application does not conform to these Terms.
(2) When all rooms are occupied.
(3) When the prospective guest is deemed likely to engage in conduct that violates laws, public order, or morals in connection with lodging.
(4) When the prospective guest is deemed to fall under any of the following:
a. Organized crime groups (boryokudan), members thereof, quasi-members, or other anti-social forces as defined in the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991), Article 2.
b. A corporation or organization whose business activities are controlled by a boryokudan or its members.
c. A corporation having an officer who is a boryokudan member.
(5) When the prospective guest engages in conduct that significantly disturbs other guests.
(6) When the prospective guest is a patient of a specified infectious disease as defined in Article 4-2, paragraph 1, item 2 of the Inn Business Law.
(7) When violent demands or unreasonably burdensome requests are made regarding lodging (excluding requests for removal of social barriers under Article 7, paragraph 2 or Article 8, paragraph 2 of the Act on Promotion of Elimination of Discrimination on the Basis of Disability).
(8) When the prospective guest repeatedly makes demands that, by the burden of implementation, significantly hinder the provision of lodging services to other guests, as specified in Article 5-6 of the Enforcement Regulations of the Inn Business Law.
(9) When lodging is impossible due to natural disasters, facility malfunctions, or other unavoidable reasons.
(10) When circumstances fall under the Miyazaki Prefecture Inn Business Law Enforcement Ordinance.
Article 5-2 (Explanation of Refusal)
A prospective guest may request the Inn to explain the reasons when the Inn refuses to enter into a lodging contract under the preceding article.
Article 6 (Right of Guest to Cancel Contract)
1. A guest may cancel the lodging contract by notifying the Inn.
2. If a guest cancels all or part of a lodging contract due to reasons attributable to the guest (excluding cases where the Inn has designated a payment deadline for the application fee under Article 3(2) and the guest cancels before such payment), the guest shall pay a penalty charge as specified in Appendix 2. However, when the Inn has agreed to special provisions under Article 4(1), this applies only when the Inn has notified the guest of the obligation to pay penalty charges upon cancellation.
3. If a guest does not arrive by 9:00 PM on the day of lodging without notice (or 2 hours after a previously specified arrival time), the Inn may treat the lodging contract as cancelled by the guest.
Article 7 (Right of Inn to Cancel Contract)
1. The Inn may cancel a lodging contract in the following cases. This paragraph does not mean the Inn may refuse lodging in cases other than those specified in Article 5 of the Inn Business Law.
(1) When the guest is deemed likely to engage in or has engaged in conduct that violates laws, public order, or morals.
(2) When the guest is deemed to fall under any of the following:
a. Organized crime groups, members, quasi-members, or other anti-social forces.
b. A corporation or organization whose business is controlled by a boryokudan or its members.
c. A corporation having an officer who is a boryokudan member.
(3) When the guest engages in conduct that significantly disturbs other guests.
(4) When the guest is a patient of a specified infectious disease.
(5) When violent demands or unreasonably burdensome requests are made regarding lodging (excluding requests for removal of social barriers under the Act on Promotion of Elimination of Discrimination on the Basis of Disability).
(6) When the guest repeatedly makes demands as specified in Article 5-6 of the Enforcement Regulations of the Inn Business Law.
(7) When lodging is impossible due to force majeure such as natural disasters.
(8) When circumstances fall under the Miyazaki Prefecture Inn Business Law Enforcement Ordinance.
(9) When the guest does not observe prohibitions of the Inn's House Rules (limited to those necessary for fire prevention), such as smoking in bed or tampering with firefighting equipment.
2. When the Inn cancels a lodging contract under the preceding paragraph, the Inn will not charge the guest for lodging services not yet received.
Article 7-2 (Explanation of Cancellation by the Inn)
A guest may request the Inn to explain the reasons when the Inn cancels a lodging contract under the preceding article.
Article 8 (Registration)
1. On the day of lodging, the guest shall register the following information by the method specified by the Inn (check-in form, email, etc.):
(1) Name, address, and contact information of the guest
(2) For foreign guests without an address in Japan: nationality and passport number
(3) Other matters deemed necessary by the Inn
2. When the guest intends to pay charges under Article 11 by means other than cash (such as accommodation coupons or credit cards), these shall be presented at the time of registration.
Article 9 (Use of Guest Rooms)
1. The guest may use the guest room from 4:00 PM until 10:00 AM the following morning. However, in the case of consecutive nights, the room may be used throughout the day except on arrival and departure dates.
2. Notwithstanding the previous paragraph, the Inn may accept use of the room outside these hours, in which case the following additional charges apply:
(1) Up to 3 hours over: 30% of the room rate
(2) Up to 6 hours over: 50% of the room rate
(3) More than 6 hours over: 100% of the room rate
3. The room rate in the previous paragraph is 70% of the basic lodging charge.
Article 10 (Observance of House Rules)
The guest shall observe the House Rules established by the Inn and posted within the premises.
Article 11 (Payment of Charges)
1. The breakdown of lodging charges and other fees payable by the guest shall be as specified in Appendix 1.
2. Payment of charges in the preceding paragraph shall be made in Japanese currency, by accommodation coupons, credit cards, or other methods accepted by the Inn, at the time of arrival or upon request by the Inn.
3. After the Inn has provided the guest room and made it available for use, the Inn shall still charge for lodging even if the guest voluntarily chooses not to use it.
Article 12 (Liability of the Inn)
1. The Inn shall compensate the guest for damages arising from the performance or non-performance of the lodging contract and related contracts. However, this shall not apply when such damages are not attributable to reasons for which the Inn is responsible.
2. The Inn carries inn liability insurance to address any fire or other incidents.
Article 13 (Handling When Contracted Rooms Cannot Be Provided)
1. If the Inn cannot provide the contracted room to the guest, the Inn shall, with the guest's consent, arrange alternative lodging of similar conditions to the extent possible.
2. Notwithstanding the previous paragraph, if alternative lodging cannot be arranged, the Inn shall pay the guest a compensation fee equivalent to the penalty charge, which shall be applied to damages. However, no compensation fee shall be paid when there is no reason attributable to the Inn for the inability to provide the room.
Article 14 (Handling of Deposited Items)
1. The Inn shall compensate for damages such as loss or destruction of items deposited at the front desk by the guest, except when such damages are due to force majeure. However, for valuables for which the Inn has requested specification of the type and value, if the guest did not specify these, the Inn shall compensate up to JPY 150,000.
2. The Inn shall compensate for damages to items, cash, or valuables brought by the guest into the Inn premises but not deposited at the front desk, when such damages are caused intentionally or by negligence of the Inn. However, for items for which the guest did not specify the type and value in advance, the Inn shall compensate up to JPY 150,000 except in cases of intentional or gross negligence by the Inn.
Article 15 (Custody of Guest Baggage or Personal Effects)
1. When the guest's baggage arrives at the Inn before lodging, the Inn shall take custody only if consented to before its arrival, and shall deliver it to the guest at check-in.
2. When the guest's baggage or personal effects are left at the Inn after check-out and the owner is identified, the Inn shall contact the owner and request instructions. If no instructions are given by the owner, or if the owner cannot be identified, the Inn shall keep them for 7 days including the day of discovery, after which they shall be reported to the nearest police station.
3. The Inn's liability for custody of guest baggage or personal effects in the previous two paragraphs shall be governed by Article 14(1) for the first paragraph and Article 14(2) for the second paragraph.
Article 16 (Liability Regarding Parking)
When the guest uses the Inn's parking facility, the Inn shall provide the place for parking and shall not be liable for managing the vehicle, regardless of whether the vehicle key is deposited. However, the Inn shall be liable for compensation in the management of the parking facility caused intentionally or by negligence of the Inn.
Article 17 (Liability of the Guest)
The guest shall compensate the Inn for damages caused by intentional or negligent acts of the guest.
